Exemption from Work Permits for foreigners marrying Vietnamese people

From January 1, 2021, a foreigner who marries a Vietnamese and lives in the territory of Vietnam will not need to apply for a work permit, nor will it need to apply for a certificate of exemption from a work permit as regulated. The old regulation takes effect from February 15, 2021.

Article 172 of the Labor Code 2012 (effective to the end of December 31, 2020) stipulates the subjects exempted from work permits are not applicable to foreigners marrying Vietnamese people and are living in the territory of Vietnam.
 
However, according to Article 154 of the Labor Code 2019 (effective from January 1, 2021), foreigners who marry Vietnamese people and living in the territory of Vietnam are not subject to grant. Work permit. Accordingly, from January 1, 2021, foreigners marrying Vietnamese citizens will be exempt from work permits.
 
At the same time, according to Article 8, Point 2, Decree 152 signed on December 30, 2020 and takes effect from February 15, 2021, this person is also not required to apply for a Certificate of foreign worker. issue a work permit, but must still report to the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor, War Invalids and Social Affairs where the foreign worker is expected to work with information such as: surname and name, age, nationality, passport number, name of the foreign employer, working start and end date at least 3 days prior to the date the foreign worker is expected to start working at Vietnam.
 
New points in the Labor Code 2019 adjust the law to suit the real situation of the country, especially adding many benefits for foreigners with family relationships with Vietnamese citizens to attract and create more conditions for foreigners to invest, work and live in Vietnam.
