Shorten the processing time for work permits

The time for processing the procedures for issuing a work permit is only 05 working days, the Department of Labor - Invalids and Social Affairs will return the result to the applicant while the previous time limit is 07 days.

In Clause 2, Article 11 of Decree 152/2020 / ND-CP on foreigners working in Vietnam, it is clear that:
 
“Within 05 working days from the date of receipt of a complete application for a work permit, the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor, War Invalids and Social Affairs where the employee is expected to work issuance of work permits for foreign workers is made according to Form No. 12 / PLI, Appendix I to this Decree. The work permit form is printed and issued uniformly by the Ministry of Labor, War Invalids and Social Affairs. In case of refusing to issue work permit, it shall reply in writing and clearly state the reason. "
 
Effect of Decree 152/2020 / ND-CP from February 15, 2021.
 
Meanwhile, in Clause 2, Article 12 of Decree 11/2016 / ND-CP detailing the implementation of a number of articles of the Labor Code regarding foreign workers working in Vietnam, clearly:
 
“Within 7 working days from the date of receipt of a complete application for a work permit, the Department of Labor, War Invalids and Social Affairs shall issue a work permit to the foreign worker according to the form issued by the Ministry of Labor. - Invalids and Social Affairs regulations. In case of refusing to issue work permit, it shall reply in writing and clearly state the reason. "
 
Thus, from February 15, 2021, the processing time for processing work permits is shortened to only 05 days.
